These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Surajit Roy, sole developer operating as ExpenseBuddy ("we," "us," or "our"), regarding your use of the ExpenseBuddy mobile application ("App") and all related services.

By downloading, installing, accessing, or using ExpenseBuddy, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree to all of these Terms, you must not use the App. These Terms apply to all users worldwide, regardless of your country of residence.

ExpenseBuddy is distributed through the Apple App Store. You acknowledge and agree that:

• These Terms are between you and ExpenseBuddy (Surajit Roy) only, and not with Apple Inc. ("Apple"). Apple is not a party to these Terms.
• ExpenseBuddy, not Apple, is solely responsible for the App and its content.
• Your use of the App must comply with the App Store Terms of Service.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.
• ExpenseBuddy, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
• In the event of any third-party claim that the App infringes that third party's intellectual property rights, ExpenseBuddy, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

To use ExpenseBuddy, you must meet the minimum age requirement applicable in your jurisdiction:

• USA At least 13 years of age (COPPA)
• EU/EEA At least 16 years of age (GDPR default; may be 13–16 depending on member state)
• UK At least 13 years of age
• CANADA At least 13 years of age (PIPEDA)
• INDIA At least 18 years of age, or with verifiable parental consent (DPDP Act, 2023)
• UAE At least 18 years of age, or with parental consent (PDPL)
• Other jurisdictions: The minimum age required by your local law, but not less than 13

Additionally, you must:

• Have the legal capacity to enter into a binding agreement under the laws of your jurisdiction
• Not be barred from using the App under any applicable laws or regulations
• Provide accurate and truthful information during registration

If you are under the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the App.

ExpenseBuddy is a personal finance application designed to help users track, split, and manage shared expenses. The App provides the following features:

To use ExpenseBuddy, you must create an account using one of the following methods:

• Email & Password: You provide a valid email address and create a secure password (minimum 6 characters)
• Google Sign-In: You authenticate using your existing Google account via OAuth

You are responsible for:

• Maintaining the confidentiality and security of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized access or breach of security
• Ensuring that the information you provide is accurate, current, and complete

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.

When using ExpenseBuddy, you agree to:

• Use the App only for its intended purpose of expense tracking and splitting
• Provide accurate and truthful expense information
• Respect the privacy and rights of other users, including friends and group members
• Not misuse the App for fraudulent activity, harassment, or any unlawful purpose
• Not attempt to reverse-engineer, decompile, or disassemble any part of the App
• Not attempt to gain unauthorized access to our systems, servers, or other users' accounts
• Not use automated tools, bots, or scripts to access or interact with the App
• Not upload or transmit any viruses, malware, or other harmful content
• Comply with all applicable local, state, national, and international laws and regulations in your use of the App

You retain ownership of all content and data you submit to ExpenseBuddy, including expense records, group information, notes, and profile data ("User Content").

By using the App, you grant us a limited, non-exclusive, non-transferable, revocable license to:

• Store, process, and display your User Content as necessary to provide the App's services
• Share your User Content with other users you have explicitly connected with (friends and group members)
• Create anonymized, aggregated data for the purpose of improving our services (no personally identifiable information is used)

We will not sell, license, or distribute your User Content to any third party outside of what is necessary to deliver the App's features. This license terminates when you delete your account.

ExpenseBuddy allows you to create groups and share expenses with other users. When participating in shared expense groups, you acknowledge and agree that:

• Visibility: All group members can view expense details, balances, and settlement records within that group
• Shared Responsibility: All group members share responsibility for the accuracy of expense data they contribute
• Profile Visibility: Your name, email address, and profile picture are visible to your friends and group members
• Notifications: Group members may send you payment reminder notifications
• Data Persistence: When you delete your account, your contributions to group expenses may be anonymized (rather than deleted) to preserve financial records for remaining group members

ExpenseBuddy offers a one-time, non-consumable in-app purchase ("ExpenseBuddy Premium") that unlocks additional features permanently.

• Payment Processing: All purchases are processed through Apple's App Store. We do not collect, store, or process any payment information directly.
• Pricing: The current price of ExpenseBuddy Premium is displayed in the App and on the App Store. Prices may vary by region and are subject to change. All prices include applicable taxes as determined by Apple and your local tax authority.
• Refunds: All purchases are subject to Apple's refund policy. Refund requests must be directed to Apple in accordance with their refund policy.
• Restore Purchases: If you reinstall the App or change devices, you can restore your purchase through the App's "Restore Purchases" feature at no additional cost.
• Lifetime Access: ExpenseBuddy Premium is a one-time purchase that grants lifetime access to premium features. There are no recurring subscription fees.

EU/EEA European consumers: Under EU consumer protection law, you have a statutory right of withdrawal for digital content purchases. However, by making a purchase and consenting to immediate delivery through the App Store, you acknowledge that the right of withdrawal may be waived as permitted under the Consumer Rights Directive (2011/83/EU). Apple handles all applicable consumer rights in accordance with their terms.

INDIA UAE All applicable consumer protection rights under local law are preserved. Refund disputes may be escalated through Apple's local support channels or through applicable consumer forums in your jurisdiction.

The free version of ExpenseBuddy displays advertisements provided by Google AdMob. By using the free version, you acknowledge that:

• Interstitial advertisements may be displayed at natural transition points within the App
• Ad content is provided by third-party ad networks and is not controlled by ExpenseBuddy
• You may be prompted to allow ad tracking via Apple's App Tracking Transparency framework
• You can remove all advertisements by upgrading to ExpenseBuddy Premium

We are not responsible for the content, accuracy, or availability of third-party advertisements. Interacting with advertisements is at your own risk.

EU/EEA Personalized advertisements are only served with your explicit, opt-in consent in compliance with ePrivacy and GDPR requirements.

All intellectual property rights in ExpenseBuddy, including but not limited to:

• The App's source code, design, layout, and user interface
• The ExpenseBuddy name, logo, and branding
• All text, graphics, icons, and visual elements
• The AI Receipt Scanner technology and algorithms
• PDF report templates and formatting

are owned by or licensed to Surajit Roy (ExpenseBuddy) and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws of India and international intellectual property treaties. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Your privacy is important to us. Our collection, use, storage, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference and fully complies with applicable data protection laws worldwide, including GDPR, CCPA/CPRA, PIPEDA, India's DPDP Act, and UAE's PDPL.

By using ExpenseBuddy, you consent to the data practices described in our Privacy Policy, including:

• Collection of account information, expense data, and device tokens
• Use of Firebase Authentication, Cloud Firestore, and Firebase Cloud Messaging
• On-device processing of receipt images via Apple's Vision framework
• Display of advertisements via Google AdMob (free tier)
• App Tracking Transparency consent for advertising personalization
• International transfer of data to Google's servers (with appropriate safeguards)

You may delete your account at any time through the App by navigating to Profile → Delete Account. Please note the following conditions:

• Balance Requirement: You must settle all outstanding balances (amounts owed and owing) before your account can be deleted. This protects the financial integrity of shared group records.
• Permanent Deletion: Account deletion is irreversible. Your personal authentication data, profile information, preferences, and device tokens will be permanently removed.
• Data Anonymization: Expense and settlement records in shared groups will be anonymized to preserve the financial ledger for other group members.
• Premium Purchases: Deleting your account does not entitle you to a refund of any in-app purchases.
• Timeframe: Personal data is purged from active systems within 30 days of deletion, in compliance with applicable data protection laws.

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these Terms. In such cases, we will provide notice where required by applicable law.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. To the fullest extent permitted by applicable law:

• No Warranty: We make no warranties, express or implied, regarding the App's reliability, accuracy, availability, fitness for a particular purpose, or non-infringement.
• No Financial Advice: ExpenseBuddy does not provide financial, legal, tax, or accounting advice. The App is a record-keeping tool only.
• Calculation Accuracy: While we strive for accuracy in expense calculations and balance tracking, we do not guarantee that all calculations are error-free. Users should verify important financial amounts independently.
• Service Availability: We do not guarantee uninterrupted access to the App. The service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
• Third-Party Services: We are not responsible for the availability, security, or performance of third-party services (Firebase, Google, Apple) that the App relies upon.

EU/EEA UK Nothing in these Terms shall exclude or limit our liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any matter which it would be illegal to exclude or restrict liability. EU/UK consumers retain all mandatory statutory consumer rights.

INDIA These limitations of liability do not override mandatory consumer protection rights under the Consumer Protection Act, 2019 or the Information Technology Act, 2000.

CANADA Some provinces do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such provinces, our liability shall be limited to the maximum extent permitted by law.

UAE This limitation of liability is subject to mandatory provisions of UAE federal law that cannot be waived by contract.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless ExpenseBuddy, its developer (Surajit Roy), affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Any disputes between you and other users regarding expenses, debts, or settlements
• Any content you submit through the App

EU/EEA UK This indemnification clause is limited by mandatory consumer protection laws. EU/UK consumers are not required to indemnify us beyond what is permitted under applicable consumer protection legislation.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions, subject to the following regional exceptions:

16.1 Dispute Resolution Process

Any disputes arising from or relating to these Terms or your use of ExpenseBuddy shall be resolved through:

1. Informal Resolution: We encourage you to contact us first to resolve any dispute informally via email at surajitroy9064@gmail.com
2. Mediation: If informal resolution is unsuccessful within 30 days, the parties agree to attempt mediation before pursuing other remedies
3. Jurisdiction: Any legal proceedings shall be brought exclusively in the competent courts of India, subject to regional exceptions below

16.2 Regional Exceptions

• EU/EEA UK EU/UK consumers may bring proceedings in their local courts in accordance with mandatory consumer protection laws. Nothing in these Terms restricts your right to file a complaint with your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
• USA U.S. users agree that any disputes will be resolved through binding arbitration on an individual basis, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration, to the extent permitted by applicable law.
• CANADA Canadian consumers retain all rights under applicable provincial consumer protection laws, including the right to bring proceedings in their home province.
• INDIA Indian users may approach the consumer forums/commissions established under the Consumer Protection Act, 2019, in addition to the courts.
• UAE UAE users may bring disputes before the competent UAE courts in accordance with Federal Law.

You agree to comply with all applicable export and re-export control laws and regulations, including the U.S. Export Administration Regulations (EAR) and economic sanctions programs administered by various governments. You represent that:

• You are not located in, or a national or resident of, any country that is subject to comprehensive U.S. or other applicable trade sanctions
• You are not on any restricted end-user list maintained by any applicable government
• You will not use the App for any prohibited end-use, including the development, design, or production of weapons of mass destruction

We reserve the right to modify, update, or replace these Terms at any time. When we make material changes:

• We will update the "Effective Date" at the top of this page
• We may display a Terms acceptance overlay within the App requiring your acknowledgment
• We may notify you via push notification or in-app notification
• For material changes affecting your rights, we will provide at least 30 days' notice before the changes take effect

Your continued use of ExpenseBuddy after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the App.

EU/EEA Material changes to these Terms that significantly alter the balance of rights and obligations will require your active acceptance before taking effect, as required by EU consumer protection law.

• Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ExpenseBuddy regarding the use of the App and supersede all prior or contemporaneous communications about this subject matter.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
• Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, pandemics, or internet service disruptions.
• No Third-Party Beneficiaries: These Terms do not confer any third-party beneficiary rights, except as expressly stated in Section 2 (Apple EULA) above.
• Language: These Terms are provided in English. In the event of a conflict between any translation and the English version, the English version shall prevail.
